1. Conclusion of contract; The accommodation contract comes into effect once the guest has booked a holiday apartment and the booking has been confirmed by the landlord or if the apartment is made available at short notice. In the interests of the contracting parties, the booking should be made in writing.
2. Landlord's obligations; The landlord undertakes to provide the holiday apartment to the guest according to the booking documents. If, despite confirmation, the landlord is unable to provide the holiday apartment, they are obliged to pay compensation. The landlord also undertakes to relet the reserved holiday apartment as soon as possible if the guest is unable to fulfil the contract, and to refund the compensation paid in full or in part in accordance with Sections 3(2) and 4 of this agreement. The landlord’s contractual liability for damages, excluding personal injury, is limited to three times the value of the agreed service unless caused by gross negligence or intent.
3. Guest obligations; A deposit of 20% of the total rental price is due within 14 days of the conclusion of the rental agreement. The remaining payment is due by bank transfer before arrival or in cash upon arrival. In accordance with Section 537 of the German Civil Code (BGB), the tenant is not exempted from paying the rental price if they are unable to use the rental property for reasons related to their person. Personal reasons include all circumstances within the guest’s personal sphere such as a travel ban, illness, or bereavement as well as situations beyond the landlord’s control (e.g. inclement weather). If the guest cancels the contract before the start of the stay, arrives late, or departs earlier than agreed, they are still required to pay the agreed rental price minus any costs saved for the days the reserved apartment is not used. A guest may only cancel the contract free of charge if the landlord grants consent in exceptional circumstances.
4. Standard rates for saved expenses; In established case law, the following values are generally used as saved expenses: 15% of the agreed price for overnight accommodation, 20% of the agreed price for overnight accommodation with breakfast, 30% of the agreed price for overnight accommodation with half board.
5. Arrival and departure; The arrival and departure days are counted as a single rental day and charged accordingly. On the day of arrival, the booked holiday apartment will be available to the guest from 5:00 p.m. unless otherwise agreed individually. On the day of departure, the booked holiday apartment is available to the guest until 10:00 a.m.
6. Prices; The valid overnight prices for the holiday apartments can be viewed in the current price list on the internet (www.reise-usedom.de). In any case, the price agreed and confirmed with the landlord shall be decisive.
7. Severability clause; Should individual provisions of this accommodation contract be or become legally invalid in whole or in part, this shall not affect the existence and validity of the legal relationship and the remaining provisions of this accommodation contract. In such cases, the contracting parties agree to replace any invalid provision with one that, as far as legally permissible, most closely reflects the original economic intent, taking into account the interests underlying the existing agreement. Statutory provisions shall apply only if no suitable adjustment can be made.
8. The place of jurisdiction is Wolgast.
