5. Cancellation by the tenant
a) Before the start of the rental period, the renter can withdraw from the rental agreement by making a written declaration to the lessor. The time of receipt of the declaration of withdrawal by the landlord is decisive.
b) If the tenant cancels the rental contract, they must pay a flat fee equal to any expenses already incurred by the landlord and any lost revenue in the following amounts: cancellation up to 60 Day before the start of the rental 50%. Thereafter, 100%. Taking this into consideration, the tenant is recommended to take out travel cancellation insurance.
c) The tenant retains the right to prove that the landlord has not been caused to suffer any losses, or only a negligible amount of loss.
d) The tenant can designate a replacement tenant who is prepared to assume the rental contract in their place. The landlord can object to the entry of the third party if this appears economically or personally unreliable. If a third party enters into the lease, he and the previous tenant are jointly and severally liable to the landlord for the rental price and the additional costs arising from the entry of the third party.
e) The landlord undertakes, in good faith, to try to let the unused accommodation to another party. If successful, the landlord undertakes to offset any money thus saved against any cancellation fees due to be paid.
f) Should the tenant depart early, they shall still be obligated to pay the full rental price.
