Cancellation of the rental agreement
1 DLV reserves the right to withdraw from the rental agreement in the event that the down payment, balance payment and deposit agreed in the rental agreement are not received by the tenant on time in DLV's account (bank details according to the rental agreement). Furthermore, the landlord has a right of cancellation in the event that the rental property cannot be used for exceptional reasons (storm damage, etc.). Claims over and above the reimbursement of the rental price (e.g. for damages) are excluded.
2. the cancellation of the rental agreement by the tenant must be made in writing. In the event of cancellation, DLV will charge the hirer a lump sum of EUR 230 to compensate for the additional expenses incurred. The lessee is permitted to prove that DLV incurred lower processing costs. In addition, the lessee must pay for the damage incurred by the lessor as a result of the cancellation. DLV will endeavour to re-let the rental period. If the complete period is successfully re-let on the same terms as the cancelled contract, the tenant will not incur any costs other than the processing costs. If it is not possible to re-let the cancelled period in whole or in part, DLV will charge the tenant a flat-rate compensation fee, which is made up as follows. A lump sum for damages amounting to 30% of the rental amount will be charged if the tenant cancels the booking in the period after conclusion of the rental agreement up to 10 weeks before arrival. If the tenancy agreement is cancelled between 10 and 4 weeks prior to arrival, a flat-rate compensation fee of 60% of the rental costs will be charged. If the booking is cancelled in the period from 28 days to the day of arrival, the tenant is obliged to pay the entire rental amount, less any expenses saved by the landlord (flat rate of 5% of the rental amount). With the consent of DLV, the tenant can find a new tenant who will assume the rights and obligations of the rental agreement. DLV recommends taking out travel cancellation insurance in case of cancellation.
